California owners and managers of apartment buildings with 3 or more units that have wooden exterior elevated elements (EEE) 6 feet or higher above the ground are subject to Senate Bill 721. Examples of this include balconies, patios, and stairways. This legislation was created in response to the tragic Berkeley deck collapse in 2015.
What IS REQUIRED to be Inspected Under SB-721?
SB-721, commonly known as "the balcony law", pertains to more than just balconies. Specifically, any structures that are elevated over 6 feet above the ground and constructed from wood or wood-based materials must be inspected. These structures include porches, stairways, walkways, decks, and elevated entry structures. To comply with SB-721, inspections must be carried out by qualified professionals.

When is the Deadline to Comply WITH SB-721?
SB-721 inspections must be completed by January 1, 2025. Following the initial inspection, subsequent inspections are required every 6 years. Failure to complete the initial inspection by the deadline or neglecting to make necessary repairs outlined in the inspection report can lead to civil penalties.
What if the Inspection Reveals Required Repairs?
If repairs are necessary for your EEE, they will be divided into two categories:
Non-Emergency Repairs: These repairs should be addressed as soon as possible, but they do not pose an immediate threat to the safety or health of your tenants. You will have 120 days to request a permit for the required non-emergency repairs after receiving your inspection report. After the permit is issued, you will have another 120 days to complete the repairs.
Emergency Repairs: Emergency repairs pose an immediate risk to the health and safety of your tenants. It's crucial to address them immediately. After completing the repairs, the E3 in question will need to be re-inspected and certified.
